Eli Trapeni: Yes it is, and they have to prove their accusations. If they do not produce evidence to support their version of how the accident occurred, i.e. that it was a result of your actions, you should prevail.It also delays when they have to pay it out. The legal system is not always who is right, but who can outlast or outspend the other side.Sucks, but it seems like your car insurance is supporting you and doing their job. The judge seems to be chivying them along and telling them to stop wasting time....Show more

Jeannetta Gaffigan: Anytime there is a lawsuit, everything comes to a crawl. The judge telling them to produce in 1 week is in hopes they do or end the case, but most likely they will get a continuance stating we still need time to talk to the witness and verify you don't know them. Then they will find other ways to delay or file more pleadings, which both sides have to answer which takes another 30 days for each side. During all this time, the cost continues to grow for hours each lawyer spends in court or typing up pleadings. Since the other side does not want to lose, they will continue to fight and hope to get their money. My guess is that this will not settle for another 6 months. Be glad you have insurance and they have to foot the bills for legal costs. good luck...Show more
